ПРОЦЕДУРА
1. Дело было инициировано жалобой (N 46372/99), поданной 6
октября 1998 г. в Европейскую комиссию по правам человека против
Греческой Республики двадцатью пятью гражданами Греции (далее -
заявители), имена которых указаны в Приложении к настоящему
Постановлению, в соответствии с бывшей статьей 25 Европейской
конвенции о защите прав человека и основных свобод.
2. Интересы заявителей представляли П. Ятагантзидис (P.
Yatagantzidis) и Е. Метаксаки (E. Metaxaki), практикующие юристы
из г. Афин. Власти Греции представляли представитель
Уполномоченного Греции при Европейском суде по правам человека М.
Апессос (M. Apessos), старший советник при Государственном Совете,
и К. Георгиадис (K. Georgiadis) юрист при Государственном Совете.
3. Заявители утверждали, в частности, о нарушении статьи 1
Протокола N 1 к Конвенции.
4. Жалоба была передана в Европейский суд 1 ноября 1998 г.,
когда вступил в силу Протокол N 11 к Конвенции (пункт 2 статьи 5
Протокола N 11 к Конвенции).
Жалоба была передана в производство Второй секции Суда (пункт 1
Правила 52 Регламента Суда). В рамках этой секции была
сформирована Палата в соответствии с пунктом 1 Правила 26
Регламента (пункт 1 статьи 27 Конвенции) для рассмотрения этого
дела.
5. Своим Решением от 4 октября 2001 г. Палата Европейского суда
признала жалобу приемлемой в части, касающейся жалоб заявителей и
нарушении статьи 1 Протокола N 1 к Конвенции. Она признала
оставшиеся требования заявителей неприемлемыми.
6. Как заявители, так и власти Греции представили свои
замечания по существу дела (пункт 1 Правила 59 Регламента).
7. 1 ноября 2001 г. Европейский суд изменил состав своих секций
(пункт 1 Правила 25 Регламента). Это дело было передано на
рассмотрение новообразованной Первой секции.
ФАКТЫ
I. Обстоятельства дела
8. Заявители участвовали в длительном разбирательстве с
государством по поводу владения землей в Оморфокклизии
(Omorphokklisia) в Галаци (Galatsi) - составная часть региона,
называющегося "владение Вейку" (Veikou Estate), на собственность
которой претендовало государство. В 1923, 1928, 1931, 1932 и 1941
году власти экспроприировали части владения Вейку для различных
общественных целей.
9. В заключении (N 23/1987), одобренном министром финансов в
1987 году и подтвержденном этим же министром в 1992 году,
Консультативный орган по общественному имуществу указал, что
владение Вейку принадлежало государству, поскольку наследники
Вейкоса ({Veikos}) <**> не смогли доказать, что права
собственности принадлежали им на основании документа о передаче
правового титула или на основании различных документов,
подтверждающих право владения собственностью. На основании этого
заключения Государственный земельный орган зарегистрировал земли,
принадлежащие наследникам Вейкоса, а впоследствии все земельные
участки, переданные ими третьим лицам, как государственное
имущество. Различные разбирательства против государства,
инициированные наследниками Вейкоса и третьими сторонами, все еще
рассматриваются национальными судами.

10. В 1934 году министр сельского хозяйства принял решение
расширить лесовосстановление в Аттике (Attica) до района,
включавшего спорные земли. В соответствии с этим решением в этом
районе "до уничтожения и вырубки лесонасаждений, там был сосновый
бор, состояние которого ухудшилось, и он начал исчезать..."
(Решение N 108424/1934).
11. Но в документе Комиссии по лесному хозяйству г. Афин от 16
ноября 1968 г. по городскому планированию указывалось, что на
половине района росли кустарники и всего пять сосен. Комиссия по
лесному хозяйству высказала мнение, что тот район никогда не был
лесным и не мог быть подвержен лесовосстановлению, поскольку
решение министерства сельского хозяйства 1934 года исключало из
района лесовосстановления не засаженные лесом земли и участки,
принадлежащие гражданам. Комиссия по лесному хозяйству установила,
что план городского развития мог быть расширен до оспариваемого
участка. Два предыдущих документа министерства сельского хозяйства
от 3 декабря 1948 г. и от 11 сентября 1949 г., а также заключение
эксперта в отношении владения Вейку пришли к одинаковому выводу.
12. 10 октября 1994 г. префект Афин решил, что район владения
Вейку, включая оспариваемый земельный участок, должен быть
подвергнут лесовосстановлению. В решении префекта четко
указывалось, что основной задачей было "... воссоздать лесные
насаждения, уничтоженные или испорченные вследствие незаконных
земляных работ и иных противоправных действий, таких, как
расчистка земли и строительство, на территории в 935483000 кв. м".
13. 23 декабря 1994 г. заявители оспорили решение префекта от
10 октября 1994 г. в Высшем административном суде. Они утверждали,
что являлись собственниками участков, образовавшихся после
разделения земли владения Вейку, которые были подвержены
лесовосстановлению. В частности, они заявляли, что решение
префекта имело целью лишить их права владения и права
собственности в отношении оспариваемого земельного участка. В их
дополнительных замечаниях от 26 июля 1996 г. они утверждали, что
подоплекой этого решения была попытка государства начать спор о
праве владения и праве собственности заявителей, оспорить то, что
в законе не было основания для принятия такого решения, поскольку
на том земельном участке никогда не рос лес.
14. 20 января 1995 г. заявители предложили государству купить
этот участок. Власти не дали никакого ответа.
15. 6 апреля 1998 г. Высший административный суд признал жалобу
заявителей неприемлемой, поскольку решение префекта было
нормоустанавливающим, так как всего лишь подтверждало Решение 1934
года министра сельского хозяйства. В частности, Высший
административный суд постановил, что Решение 1934 года оставалось
в силе, поскольку оно не изменялось другим актом такой же силы.
Последующие акты органов власти, такие, как описание
аэрофотосъемки, не могут рассматриваться как новая оценка
ситуации, могущая сделать решение префекта нормоустанавливающим.
16. 22 октября 1999 г. Комиссия по лесному хозяйству Афин в
соответствии с процедурой, установленной Законом N 998/1979,
систематизировала 189475 кв. м земли, расположенной в районе
действия Решения префекта от 10 октября 1994 г. Она установила,
что всего 20650 кв. м этого участка было засажено лесом и должно
было подвергнуться лесовосстановлению. Комиссия по разрешению
лесных споров поддержала это решение и жалобу, рассматриваемую
Апелляционной коллегией.
17. Греческие суды за последние несколько лет неоднократно
выносили решения о праве собственности на земельные участки
владения Вейку (Решение суда первой инстанции г. Афины N
8864/1995, Решение апелляционного суда г. Афины N 8314/1996, и
Решение апелляционного суда г. Афины N 9632/2000). Суды
установили, что участки владения Вейку не являются лесными
массивами, и они принадлежат на праве собственности их владельцам,
хотя и были включены в план городского развития. Другие Судебные
решения (Решение суда первой инстанции г. Афины N 13789/1977,
Решение апелляционного суда г. Афины N 7350/1978, решение
Кассационного суда г. Афины N 696/1980, Решение суда первой
инстанции г. Афины N 1865/1992 и Решение суда первой инстанции г.
Афины N 1783/1997) устанавливали, что владение Вейку, включавшее в
себя оспариваемые земельные участки, никогда ранее не являлось
лесным массивом.
II. Применимое национальное законодательство и практика
A. Конституция
18. Соответствующие положения Конституции гласят:
Пункт 1 статьи 24
"Охрана природной и культурной окружающей среды является
обязанностью государства. Государство обязуется принимать
специальные превентивные или репрессивные меры для ее охраны.
Закон определяет вопросы, касающиеся охраны лесов и в целом лесных
территорий. Запрещается применение целевой функции государственных
лесов и лесных территорий, если для интересов национальной
экономики не является более важным их сельскохозяйственная
эксплуатация или иное использование, диктуемое государственными
интересами".
Пункт 3 статья 117
"Государственные или частные леса или лесные территории,
уничтожаемые или уничтоженные ранее вследствие пожара либо
ликвидируемые или ликвидированные ранее иным способом, не
утрачивают по этой причине своего характера, который они имели до
уничтожения (ликвидации), и в обязательном порядке объявляются
подлежащими восстановлению, исключая при этом их использование с
иной целью".
19. Власти Греции утверждали, что в целях пункта 3 статьи 117,
которая имеет непосредственное применение в соответствии с
судебной практикой Высшего административного суда, законодательная
охрана лесов обеспечивалась без ограничений во времени и несмотря
на уничтожение и ликвидацию. Кроме того, обозначение района, как
подлежащего лесовосстановлению, и запрещение каких-либо действий,
вредящих лесовосстановлению, является обязательным.
B. Закон "О защите лесов и лесных массивов"
(Закон N 998/1979)
20. Соответствующие положения Закона N 998/1979 гласят:
Статья 10(3)
"В каждой префектуре необходимо учредить Комиссию по разрешению
лесных споров для урегулирования вопросов, связанных с признанием
земельных участков лесными массивами и установлением их границ".
Статья 14
"1) Комиссия по лесному хозяйству должна признавать земельные
участки лесными массивами и определять их границы, если это не
указано в лесном реестре, в соответствии с законным требованием
заинтересованных лиц.
2) ... О таком признании сообщается гражданину, юридическому
лицу или государственному органу, сделавшему запрос...
3) Префект или иное заинтересованное лицо может подать жалобу
на вышеуказанное признание в течение двух месяцев со дня
сообщения... в Комиссию, указанную в статье 10(3)... Комиссия или
Апелляционная коллегия... в течение трех месяцев со дня
поступления жалобы должна принять обоснованное решение...".
Статья 38(1)
"Леса и лесные массивы, которые сгорели в результате пожара или
уничтожены в результате незаконной вырубки, должны быть подвержены
лесовосстановлению, даже если они относятся к особой категории или
располагаются в особом месте...".
Статья 41
"1) Решение о признании земельного участка подлежащим
лесовосстановлению принимается уполномоченным префектом. Оно
должно устанавливать точные границы этого участка и к нему должна
быть приложена карта...
(...)
3) ... указанное в пункте 1 решение префекта должно быть
принято с учетом рекомендации соответствующего лесного
инспектора".
21. Власти Греции подчеркивали, что вышеуказанные положения
устанавливают особую юридическую процедуру признания земельного
участка лесным массивом и имеют своей целью урегулирование споров,
ограничив права как властей, так и граждан.
ПРАВО
I. Предполагаемое нарушение
статьи 1 Протокола N 1 к Конвенции
22. Заявители жаловались на нарушение статьи 1 Протокола N 1 к
Конвенции, которая гласит:
"Каждое физическое или юридическое лицо имеет право на уважение
своей собственности. Никто не может быть лишен своего имущества,
иначе как в интересах общества и на условиях, предусмотренных
законом и общими принципами международного права.
Предыдущие положения не умаляют права государства обеспечивать
выполнение таких законов, какие ему представляются необходимыми
для осуществления контроля за использованием собственности в
соответствии с общими интересами или для обеспечения уплаты
налогов или других сборов или штрафов".
23. Во-первых, как заявители указывали в своих замечаниях на
стадии приемлемости, они вновь заявили, что власти Греции не
выразили свое отношение к существу их жалобы на стадии признания
наличия факта нарушения.
24. Во-вторых, заявители утверждали, что имела место
экспроприация без соответствующего материального возмещения
национальными и региональными властями того, что они считали своей
собственностью. На самом деле, государство под разными предлогами,
такими, как существование леса в прошлом, пыталось "отнять" их
собственность. Даже если считалось, что государство не лишало
заявителей их собственности, а всего лишь ограничило ее
использование, это не представляло собой справедливого баланса
между правами, гарантированными статьей 1 Протокола N 1 к
Конвенции и ограничениями: в настоящем деле никакой общественный
интерес не может оправдать такое ограничение права собственности и
отсутствие какой-либо компенсации, которая могла бы восстановить
справедливый баланс. В связи с этим заявители подчеркивали, что в
соответствии с Законом N 998/1979 государство могло купить
собственность, находящуюся в плане на лесовосстановление.
Заявители подали запрос о покупке их собственности, но
соответствующий государственный орган не дал ответа, тем самым
подтвердив отказ государства выплатить какую-либо компенсацию.
25. Заявители привели несколько Судебных решений (Решение суда
первой инстанции г. Афины N 8864/1995, Решение апелляционного суда
г. Афины N 8314/1996 и Решение апелляционного суда г. Афины N
9632/2000), в которых суды Греции определяли статус владения
Вейку. Из этих решений вытекало, что суды сочли, что несколько
деревьев, находящихся на территории владения Вейку, не
представляли собой лесного массива, а являлись частной
собственностью, которая была включена в план городского развития.
Другие Судебные решения (Решение суда первой инстанции г. Афины N
13789/1977, Решение апелляционного суда г. Афины N 7350/1978,
Решение Кассационного суда г. Афины N 696/1980, Решение суда
первой инстанции г. Афины N 1865/1992 и Решение суда первой
инстанции г. Афины N 1783/1997) устанавливали, что во владении
Вейку, являющемся собственностью заявителей, никогда не было леса
в прошлом.
26. Заявители подчеркивали, что административные органы,
принявшие решение о лесовосстановлении, подразумевали под
указанными земельными участками общественную собственность и
полностью отвергали Судебные решения, выданные в пользу
заявителей. Заявители также утверждали, что спорный земельный
участок не мог представлять собой лесной массив ввиду характера и
состава почвенного и подпочвенного слоев. Такой вывод можно было
сделать на основании ряда технических докладов и экспертных
оценок, проведенных в 1993, 1995, 1996, 1997 и 2000 годах
лесниками, университетскими профессорами и экспертами в области
геологии и лесного хозяйства. Кроме того, определенные
административные документы и решения (лесная карта министерства
сельского хозяйства, указ Президента от 28 августа 1980 г.,
установившего правила застройки в районе Галаци и мнение Комиссии
по лесному хозяйству г. Афины от 14 ноября 1968 г.) подтверждали,
что оспариваемый участок земли всегда рассматривался как
пастбищный и пахотный. Также, в 1957 году, органы власти
ограничили лесной массив в этом районе, не включив лес, растущий
на оспариваемом земельном участке, в него.
27. В заключение, заявители сказали, что никакой общественный
интерес не мог оправдать такое радикальное ограничение их прав
собственности, приняв во внимание, что какое-либо
лесовосстановление было невозможно ввиду типа и качества почвы.
28. Основным доводом аргументов властей Греции было то, что
"право владения" заявителей в смысле статьи 1 Протокола N 1 к
Конвенции не было нарушено. Власти Греции сочли, что владельцем
владения Вейку было государство и что греческие суды обладали
достаточными полномочиями для решения вопроса о владении спорными
земельными участками.
29. Утверждение заявителей, что эти земельные участки, границы
которых не были точно определены в жалобе, принадлежали им, не
подтверждает, что они на самом деле принадлежали им. Пытаясь
доказать свое право собственности на спорную землю, заявители
ссылались на Судебные решения и административные документы,
касавшиеся их собственности (которые подтверждали их право
собственности и признание их частью лесного массива), и пытались
использовать Европейский суд по правам человека как гражданский
суд, который мог бы разрешить вопрос о праве собственности или
определить, был ли оспариваемый участок земли в прошлом лесным
массивом. Но национальные суды не приняли ни одного Решения, в
отношении права собственности заявителей на земельные участки.
Высший административный суд всего лишь установил, были ли
соблюдены необходимые условия для признания земельных участков,
подлежащими лесовосстановлению, и в частности, было ли решение
префекта законным и достаточно обоснованным в свете пункта 3
статьи 117 Конституции и положений Закона N 998/1979. Вопрос о
праве собственности на все владение Вейку находился на
рассмотрении национальных судов, в то время как было подано
несколько жалоб (в соответствии со статьей 70 Гражданского
процессуального кодекса Греции), требующих признать право
собственности на отдельные участки земли. Но заявителей среди
таких апеллянтов не было.
30. Власти Греции добавили, что ни Постановление Высшего
административного суда, ни решение префекта о лесовосстановлении
не нарушали права заявителей, предусмотренные статьей 1 Протокола
N 1 к Конвенции. При рассмотрении вопроса приемлемости жалобы по
статье 6 Конвенции Европейский суд постановил, что Решение Высшего
административного суда о том, что решение префекта не являлось
нормоустанавливающим актом, не было случайным. Кроме того, в
соответствии со статьей 117 Конституции охрана лесов
обеспечивалась без ограничений во времени и несмотря на
уничтожение и ликвидацию. Решение восстановить лес не было
оставлено на усмотрение властей, а должно было быть принято в
случае необходимости и при соблюдении условий, указанных в статье
117. Высший административный суд на основании большого количества
доказательств установил, что, возможно, оспариваемый участок в
прошлом был лесом. Следовательно, решение префекта не было
произвольным, а исходило из общественного интереса, а именно из
охраны окружающей среды.
31. Власти Греции оспаривали относимость к делу представленных
заявителями документов. Они ссылались на другие документы,
принятые Комиссией по лесному хозяйству г. Афины и на Решение N
1/2001 апелляционной коллегии по разрешению лесных споров, которые
приходили к иным выводам, чем документы, представленные
заявителями.
32. Наконец, власти Греции заявили, что государство могло
купить оспариваемые земли в соответствии с Законом N 998/1979,
поскольку оно всегда считало их своей собственностью.
33. Европейский суд напомнил, что статья 1 Протокола N 1 к
Конвенции, гарантирующая право собственности, включает три
отдельных правила (см. Постановление Европейского суда по делу
"Джеймс и другие против Соединенного Королевства" (James and
Others v. United Kingdom) от 21 февраля 1986 г., Series A, N 98,
pp. 29 - 30, з 37). Первое правило изложено в первом предложении
пункта 1, оно носит общий характер и устанавливает принцип мирного
пользования собственностью. Второе правило, содержащееся во втором
предложении того же пункта, касается лишения права собственности и
предоставляет для этого ряд условий. Третье правило заключено в
пункте 2, оно гласит, что Договаривающиеся государства должны,
кроме прочего, контролировать пользование собственности в
соответствии с общими интересами. Второе и третье правила,
касающиеся определенных случаев вмешательства в право
беспрепятственного пользования собственностью, должны толковаться
в свете общего принципа, заключенного в первом правиле.
34. Что касается вопроса о том, имеет ли место "право
собственности" по смыслу статьи 1 Протокола N 1 к Конвенции, то в
задачи Европейского суда не входит установление права
собственности на оспариваемую землю. Власти Греции подчеркнули,
что заявители не смогли установить право собственности в
гражданских судах. Европейский суд отметил, что власти Греции
утверждали, что заявители не исчерпали все внутренние средства
правовой защиты на стадии оценки приемлемости. Европейский суд
отклонил это утверждение, касавшееся оценки приемлемости, на том
основании, что единственным судом, который мог отменить решение
префекта, был Высший административный суд. Что касается существа
дела, Европейский суд отметил следующее: в своем заявлении в
Высший административный суд заявители указали документы, на
которых они основывали свое требование о сохранении права
собственности на оспариваемые земли. Хотя он и не должен был
разрешать вопрос о праве собственности, чего он и не мог бы
сделать, Высший административный суд признал, что заявители,
"считавшиеся собственниками", обладали locus standi.
35. Для рассмотрения дела в Европейском суде заявители должны
рассматриваться как собственники земли или хотя бы как
заинтересованные лица, чтобы подпадать под действие статьи 1
Протокола N 1 к Конвенции.
36. Европейский суд отметил, что доводы властей Греции о том,
что законодательная охрана лесов обеспечивалась без ограничений во
времени и вне зависимости от незаконного уничтожения или
ликвидации. Кроме того, признание района подлежащим
лесовосстановлению и запрещение каких-либо действий, вредящих
лесовосстановлению, не подлежит оставлению на рассмотрение
властей, а является мандатарным, и Высший административный суд
усердно претворял в жизнь эти принципы, чтобы обезопасить лесные
ресурсы страны. Европейский суд также отметил, что заявители
оспаривали решение префекта о лесовосстановлении по настоящему
делу, принятое в общественных интересах, поскольку геология всего
района была неблагоприятна для лесоразведения. Европейский суд
отметил, что существовало большое количество противоречивых
доказательств, касающихся характера оспариваемых земельных
участков. Как отметили обе стороны, по этому делу были судебные и
административные решения, экспертные оценки и другие документы,
подтверждающие обе точки зрения. Но в задачи Европейского суда не
входит решение таких технических вопросов.
37. Европейский суд отметил, что решение префекта от 10 октября
1994 г. основывалось на Решении N 108424/1934 министра сельского
хозяйства. По мнению Европейского суда, органы власти совершили
ошибку, применив такие серьезные меры, которые повлияли на
положение заявителей по настоящему делу и на количество других
лиц, заявляющих о праве собственности на землю, переоценив
ситуацию, описанную в Решении N 108424/1934. Но Высший
административный суд отклонил жалобы заявителей только лишь на том
основании, что решение префекта не носило нормоустанавливающего
характера, так как оно всего лишь подтверждало решение, принятое в
1934 году министром сельского хозяйства. Такой порядок
рассмотрения дела в случаях подобной сложности, где любое
административное решение может повлиять на право собственности
большого числа людей, не может считаться соответствующим праву,
предусмотренному статьей 1 Протокола N 1 к Конвенции, и не
обеспечивает должной защиты таких людей, как заявители, которые
добросовестно владеют собственностью, в частности, когда нельзя
представить, что в соответствии с законами Греции, нет возможности
получить материальную компенсацию.
38. Европейский суд счел, что оспариваемая заявителями ситуация
подпадает под действие первого предложения пункта 1 статьи 1
Протокола N 1 к Конвенции и что не было установлено справедливого
баланса между общественными интересами и требованиями о защите
прав заявителей.
39. Таким образом, нарушение статьи 1 Протокола N 1 к Конвенции
имело место.
II. Применение статьи 41 Конвенции
40. Статья 41 Конвенции гласит:
"Если Суд объявляет, что имело место нарушение Конвенции или
Протоколов к ней, а внутреннее право Высокой Договаривающейся
Стороны допускает возможность лишь частичного устранения
последствий этого нарушения, Суд, в случае необходимости,
присуждает справедливую компенсацию потерпевшей стороне".
41. Заявители требовали выплатить им 504482000 драхм или
1480505 евро в возмещение материального ущерба. Эта сумма основана
на заключении эксперта, проведенном гражданским инженером, нанятым
заявителями, по оценке ценности оспариваемых земель. Эксперт
основывался в своем заключении на рыночной стоимости соседних
земель и на Решении суда первой инстанции г. Афин, который
определил сумму, подлежащую выплате за один квадратный метр в
качестве компенсации за экспроприированную с целью проведения
Олимпийских игр 2004 года собственность.
42. Что касается морального вреда, заявители сказали, что
Постановление Европейского суда, устанавливающее наличие нарушения
статьи 1 Протокола N 1 к Конвенции, является достаточной
справедливой компенсацией их требований, и они требовали
символической компенсации в сумме один евро. Они подтверждали, что
вмешательство государства в их право собственности вызвало у них
душевные страдания и беспокойство и что они оказались в очень
затруднительном положении, поскольку большинство из них купили
земельные участки по очень высокой цене, будучи очень
ограниченными в ресурсах.
43. Что касается судебных расходов и издержек, понесенных в
ходе разбирательств в Высшем административном суде, заявители
требовали 200000 драхм за каждый экспроприированный участок, что
составило всего 4800000 драхм, или 14087 евро. Что касается
разбирательств в Европейском суде, заявители подчеркнули сложность
дела и тот факт, что им пришлось нанять двух адвокатов, которые
потратили 980 рабочих часов на эту жалобу при оплате 50000 драхм в
час (всего 40000000 драхм, или 143800 евро). К этой сумме
необходимо прибавить 1000000 драхм выплаченных гражданскому
инженеру, который проводил оценку стоимости земли заявителей.
44. Власти Греции утверждали, что у заявителей не было права на
компенсацию: с одной стороны, они не были признаны гражданскими
судами собственниками оспариваемых земельных участков, а с другой
стороны, - решение о лесовосстановлении не препятствовало всем
правомочиям собственника, а лишь тем, которые затрудняли
лесовосстановление и не соответствовали признанию земельных
участков лесными массивами.
45. Власти Греции утверждали, что требования заявителей в
отношении судебных издержек были чрезмерными и необоснованными. В
частности, количество рабочих часов и их стоимость были
преувеличены.
46. В соответствии с обстоятельствами дела Европейский суд
счел, что вопросы, связанные с применением статьи 41 Конвенции,
еще не готовы для принятия по ним решения, и ее применение должно
быть отложено, и должно быть уделено внимание возможному мировому
соглашению между государством-ответчиком и заявителем.
НА ЭТИХ ОСНОВАНИЯХ СУД ЕДИНОГЛАСНО:
1) постановил, что имело место нарушение статьи 1 Протокола N 1
к Конвенции;
2) постановил, что вопрос о применении статьи 41 Конвенции не
готов к разрешению; следовательно Европейский суд,
a) откладывает разрешение этого вопроса целиком;
b) предлагает властям Греции и заявителю в течение последующих
трех месяцев представить письменные замечания по делу и поставить
Европейский суд в известность о любом мировом соглашении, которое
они смогут заключить;
c) откладывает дальнейшее рассмотрение дела и предоставляет
председателю Палаты право в случае необходимости возобновить
рассмотрение дела.

PROCEDURE
1. The case originated in an application (No. 46372/99) against
the Hellenic Republic lodged with the European Commission of Human
Rights ("the Commission") under former Article 25 of the
Convention for the Protection of Human Rights and Fundamental
Freedoms ("the Convention") by 25 Greek nationals, ("the
applicants"), whose names appear in the annex, on 6 October 1998.
2. The applicants were represented by Mr P. Yatagantzidis and
Mrs E. Metaxaki, lawyers practising in Athens. The Greek
Government ("the Government") were represented by the Delegate of
their Agent, Mr M. Apessos, Senior Adviser at the State Legal
Council and Mr K. Georgiadis, Legal Assistant at the State Legal
Council.
3. The applicants alleged, in particular, a violation of
Article 1 of Protocol No. 1.
4. The application was allocated to the Second Section of the
Court (Rule 52 з 1 of the Rules of Court). Within that Section,
the Chamber that would consider the case (Article 27 з 1 of the
Convention) was constituted as provided in Rule 26 з 1.
5. By a decision of 4 October 2001 the Court declared the
application admissible in so far as it concerned the applicants'
complaint under Article 1 of Protocol No. 1. It declared
inadmissible the remainder of the application.
6. The applicants and the Government each filed observations on
the merits (Rule 59 з 1).
7. On 1 November 2001 the Court changed the composition of its
Sections (Rule 25 з 1). This case was assigned to the newly
composed First Section.
THE FACTS
I. The circumstances of the case
8. The applicants are involved in a long-standing dispute with
the State concerning the ownership of a plot of land in
Omorphokklisia in Galatsi, part of a wider area called "{Veikou}
Estate" whose ownership is claimed by the State. In 1923, 1928,
1931, 1932 and 1941 the State expropriated for various purposes of
public interest large parts of the {Veikou} Estate.
9. According to Opinion No. 23/1987 of the Consultative Board
of Public Estates, which was approved by the Minister of Finance
in 1987 and confirmed by the same Minister in 1992, the {Veikou}
Estate belongs to the State, since the heirs of Mr {Veikos} failed
to prove that they had property rights resulting from title deeds
or adverse possession on the estate. On the basis of that opinion,
the State Lands Authority registered as public estates, at first
the area possessed by the heirs of Mr {Veikos} and then all the
plots which had been transferred to third parties by these heirs.
Several proceedings against the State, engaged by the heirs of Mr
{Veikos} as well as by third parties, are still pending before the
domestic courts.
10. In 1934 the Minister of Agriculture decided to reafforest a
wider region of Attica which included the disputed plot of land.
According to that decision, the area "consisted, before the
destruction and downgrading of the forest vegetation..., of pine-
tree forest which was progressively downgraded and tended to
disappear..." (decision No. 108424/1934).
11. However, in a document of the Forest Inspection of Athens
of 16 November 1968 related to city planning, it was stated that
half of the area concerned was agricultural and half of it covered
by bush and only five pine-trees. The Forest Inspection expressed
the opinion that it had never been a forest and could not be
reafforested, since the decision of the Ministry of Agriculture of
1934 excluded from the scope of the reafforestation barren land or
plots owned by individuals. The Forest Inspection concluded that
the city plan could be extended to the impugned area. Two previous
documents of the Ministry of Agriculture, dated 3 December 1948
and 11 September 1949, as well as an expert report concerning the
{Veikou} Estate had arrived at the same conclusion.
12. On 10 October 1994 the prefect of Athens decided that an
area within the {Veikou} Estate, including the disputed plot of
land, should be reafforested. As it was expressly stated in the
prefect's decision, the aim was "... to recreate the forest
greenery destroyed or downgraded by illegal quarry activities and
other illegal actions such as land clearing, constructions etc. in
an area of 935,483,000 sq. m.
13. On 23 December 1994 the applicants challenged the decision
of the prefect of 10 October 1994 before the Council of State.
They claimed that they were owners of properties that originated
from the parcelling of the {Veikou} Estate and which were located
inside the reafforestable area. In particular, in their appeal,
they contended that the prefect's decision aimed at depriving them
of any property or possession rights on the contested plot. In
their additional observations of 26 July 1996, they claimed that
the reason behind that decision was an attempt of the State to
create a dispute over the property or possession rights of the
applicants, although the legal conditions for the issuance of such
a decision were not met since the area had never been a forest in
the past.
14. On 20 January 1995 the applicants invited the State to
purchase the plot in question from them. The authorities did not
reply.
15. On 6 April 1998 the Council of State declared the
applicants' appeal inadmissible on the ground that the prefect's
decision was not an executory act since it simply confirmed the
decision issued by the Minister of Agriculture in 1934. In
particular, the Council of State held that the decision of 1934
remained in force because no other act, of an equivalent force,
had reversed it. The subsequent acts of the Administration, such
as the interpretation of some aerial photos, could not be
considered as a new assessment of the situation which could give
to the decision of the prefect an executory character.
16. On 22 October 1999 the Forest Inspection of Athens
qualified, according to the procedure prescribed by Law No.
998/1979, an area of 189,475 sq. m. located within the area
concerned by the prefect's decision of 10 October 1994. The Forest
Inspection concluded that only 20,650 sq. m. of that surface was
forest and should be reafforested. The Committee for the
Settlement of Forest Disputes confirmed that decision and an
appeal is now pending before the Appeal Committee.
17. In various judgments delivered during the past years the
Greek courts have had the occasion to decide the property status
of part of the {Veikou} Estate (judgments No. 8864/1995 of the
First Instance Court of Athens, no. 8314/196 of the Court of
Appeal of Athens, No. 9632.2000 of the Court of Appeal of Athens).
The courts have recognised that a number of plots which were
situated in the greater area of the {Veikou} Estate did not
constitute a forest but were private properties which were
included in the development plan of the city. Some other judicial
decisions (judgments No. 13789/1977 of the First Instance Court of
Athens, no. 7350/1978 of the Court of Appeal of Athens, No.
696/1980 of the Court of Cassation, no. 1865/1992 of the First
Instance Court of Athens, No. 1783/1997 of the First Instance
Court of Athens) concluded that the greater area, which comprised
the properties claimed by the applicants, had never been a forest
in the past.
II. Relevant domestic law and practice
The Constitution
18. The relevant provisions of the Constitution read as
follows:
Article 24 з 1
"The protection of the natural and cultural environment
constitutes a duty of the State. The State is bound to adopt
special preventive or repressive measures for the preservation of
the environment. Matters pertaining to the protection of forests
and forest areas in general shall be regulated by law. Alteration
of the use of State forests and State forest areas is prohibited,
except where agricultural development or other uses imposed for
the public interest prevail for the national economy."

"Public or private forests or forest areas which have been
destroyed or are being destroyed by fire or have otherwise been
deforested or are being deforested, shall not thereby relinquish
their previous designation and shall compulsorily be proclaimed
reafforestable, the possibility of their disposal for other uses
being excluded."
19. The Government submit that, in the sense of Article 117 з 3
which, in accordance with the established case-law of the Council
of State is directly applicable, the protection of forests is
enacted without any time-limit and is not obstructed by any
illegal destruction or deforestation. Moreover, the declaration of
an area as reafforestable and the prohibition of any use that
would obstruct reafforestation is not left to the discretion of
the Administration but is mandatory.
Law No 998/1979
relating to the protection of forests and forest expanses
20. The relevant articles of Law No. 998/1979 read as follows:

"A Committee for the Settlement of Forest Disputes is
established at the seat of each prefecture, which is competent to
settle disputes concerning the character of an area or part of the
surface as forest area or the limits of it."
Article 14
"1. If no forest registry has been drawn up, the
characterisation of an area or part of the surface as forest area
and the determination of the limits thereof... is made at the
request of any person having a lawful interest or ex officio, by
act of the competent forest inspector.
2. ... The act is notified to the person, legal entity or
public service which has submitted the request...
3. The prefect or any other person who has lawful interest may
object to the above-mentioned act, within two months from the
notification..., before the Committee mentioned in Article 10 з
3... The Committee and the Appeal Committee... decides by a
reasoned decision within three months from the filing of the
objection..."
Article 38 з 1
"Forests and forest areas which are destroyed or deforested by
fire or illegal logging are declared reafforestable, regardless of
their special category or their location..."
Article 41
"1. The decision declaring an area as reafforestable is taken
by the competent prefect. It clearly indicates the limits of the
area and is accompanied by a plan...
3. ... the decision of the prefect mentioned in paragraph 1 is
taken following the recommendation of the competent forest
inspection."
21. The Government stress that the above-mentioned Articles
establish a special judicial procedure for the characterisation of
an area as forest area and aim at settling disputes in a binding
way for both the Administration and the individuals.
THE LAW
I. Alleged violation of Article 1 of Protocol No 1
22. The applicants alleged a violation of Article 1 of Protocol
No. 1, which reads as follows:
"Every natural or legal person is entitled to the peaceful
enjoyment of his possessions. No one shall be deprived of his
possessions except in the public interest and subject to the
conditions provided for by law and by the general principles of
international law.
The preceding provisions shall not, however, in any way impair
the right of a State to enforce such laws as it deems necessary to
control the use of property in accordance with the general
interest or to secure the payment of taxes or other contributions
or penalties."
23. Firstly, as they had already stressed in their observations
at the admissibility stage, the applicants reiterated that the
fact that the Government had not expressed any views on the
substance of the applicants' complaint at that stage amounted to
an indirect but clear recognition of the violation.
24. Secondly, the applicants submitted that the taking of what
they consider their property by the national and regional
authorities amounted to a de facto expropriation without the
payment of any compensation. In effect, by using various pretexts
such as the existence of a forest in the remote past, the State
tried to "snatch" their property. Even if one considered that the
State did not deprive the applicants of their property, but only
restricted its use, it did not respect a fair balance between the
right guaranteed by Article 1 of Protocol No. 1 and the
limitation: in the present case no public interest could justify
such a limitation placed on the property concerned and the lack of
any compensation which could have restored the fair balance. In
this connection, the applicants stressed that according to Law
998/1979, the State could buy the properties which were included
in a reafforestation scheme. The applicants had submitted a
request to have their properties purchased but the competent
authorities never answered to their request; they thus confirmed
the refusal of the State to pay any compensation to the
applicants.
25. The applicants submitted a great number of judicial
decisions (judgments No. 8864/1995 of the First Instance Court of
Athens, No. 8314/196 of the Court of Appeal of Athens, No.
9632.2000 of the Court of Appeal of Athens) whereby the Greek
courts decided the property status of the {Veikou} Estate. It
transpired from these decisions that the courts had recognised
that a number of plots which were situated in the greater area of
the {Veikou} Estate did not constitute a forest but were private
properties which were included in the development plan of the
city. Some other judicial decisions (judgments No. 13789/1977 of
the First Instance Court of Athens, No. 7350/1978 of the Court of
Appeal of Athens, No. 696/1980 of the Court of Cassation, No.
1865/1992 of the First Instance Court of Athens, No. 1783/1997 of
the First Instance Court of Athens) concluded that the greater
area which comprised the applicants' properties had never been a
forest in the past.
26. The applicants stressed that the administrative authorities
which decided the reafforestation referred to the area as a public
domain and totally ignored the judicial decisions which were
favourable to the applicants. The applicants further claimed that
the disputed area could not constitute a forest because of the
nature and the composition of the soil and the subsoil. Such a
conclusion could be drawn from several technical reports and
expert valuations carried out in 1993, 1995, 1996, 1997 and 2000
by foresters and even University professors and experts in geology
and forestry. Furthermore, some administrative decisions (forest
map of the Ministry of Agriculture, Presidential decree of 28
august 1980 fixing building conditions in the area, Presidential
Decree of 11 November 1991 approving the development plan of the
Galatsi area, opinion of the Forest inspection of Athens of 14
November 1968) supported the position that the disputed land had
always been considered as grazing or arable land. Moreover, in
1957, the Administration delimited the forest land in the area
without including in it the disputed plots.
27. In conclusion, the applicants maintained that no public
interest could justify such a drastic limitation of their property
rights, taking into account that any reafforestation of the land
was impossible because of the nature and the quality of the soil.
28. The principal thrust of the Government's argument was that
no "possession" of the applicants, within the meaning of Article 1
of Protocol No. 1, had been subject to interference. The
Government considered that the State was the owner of the broader
area of the {Veikou} Estate and that only the Greek courts were
competent to resolve the ownership status of the disputed plots.
29. The mere allegation of the applicants that they were owners
of these plots, which were not precisely delineated in their
application, did not mean that they were actually owners. The
applicants, in an attempt to prove their ownership rights on the
disputed land, invoked judicial decisions and administrative
documents which concern other properties (both for the ownership
status and the character as a forest) and tried to use the
Strasbourg Court as a civil court which could resolve the
ownership status of their plots or could determine whether the
disputed land formed a forest in the past. However, no decision
has been taken by the domestic courts as regards the ownership
status of the applicants' plots. The Council of State only
examined whether the conditions for declaring the area
reafforestable were met, in particular whether the prefect's
decision was lawful and sufficiently justified in relation to
Article 117 з 3 of the Constitution and other provisions of Law
998/1979. The determination of the ownership status of the whole
{Veikou} Estate was still pending before the domestic courts,
following several actions (on the basis of Article 70 of the Code
of Civil Procedure) introduced by persons claiming ownership
rights on certain plots. However, the applicants never introduced
such an action.
30. Neither the judgment of the Council of State nor the
prefect's decision to reafforest violated the applicants' rights
under Article 1. In deciding the admissibility of the complaint
under Article 6 of the Convention, the Court held that the Council
of State's finding that the prefect's decision was not an
executory act, was not arbitrary. Furthermore, according to
Article 117 of the Constitution, the protection of forests is
guaranteed without any time-limit in the past and cannot be
obstructed by any act of destruction and deforestation
accomplished illegally. A decision to reafforest is not left to
the discretion of the Administration but must be obligatorily
taken when necessary and when the conditions provided for in
Article 117 are met. The Council of State, based on a great amount
of evidential material, held that it was probable that the
disputed area constituted a forest in the past. It followed that
the prefect's decision was not arbitrary but dictated by reasons
of public interest, namely the protection of the environment.
31. The Government contested the relevance of the documents
invoked and submitted by the applicants. They referred to other
documents issued by the Forest Inspection of Athens and to
decision No. 1/2001 of the Second Instance Committee for the
Settlement of Forest Disputes, which drew different conclusions
from those indicated in the applicants' documents.
32. Finally, the Government maintained that it was impossible
for the State to purchase the disputed plots according to the
provisions of Law 998/1979, since it considered and still
considers them as its own property.
33. The Court recalls that Article 1 of Protocol No. 1, which
guarantees in substance the right of property, comprises three
distinct rules (see the James and Others v. the United Kingdom
judgment of 21 February 1986, Series A No. 98-B, з 37). The first,
which is expressed in the first sentence of the first paragraph
and is of a general nature, lays down the principle of peaceful
enjoyment of property. The second rule, in the second sentence of
the same paragraph, covers deprivation of possessions and subjects
it to certain conditions. The third, contained in the second
paragraph, recognises that the Contracting States are entitled,
amongst other things, to control the use of property in accordance
with the general interest. The second and third rules, which are
concerned with particular instances of interference with the right
to peaceful enjoyment of property, are to be construed in the
light of the general principle laid down in the first rule.
34. As regards the question whether there was a "possession"
within the meaning of Article 1, it is not for the Court to settle
the issue of the ownership status of the disputed land. The
Government underline that the applicants failed to have determined
this status by the civil courts. The Court recalls that at the
admissibility stage the Government had raised the objection that
the domestic remedies had not been exhausted in this connection.
The Court dismissed the objection on the ground that for the
purposes of the admissibility the only competent court which could
quash the prefect's decision to reafforest was the Council of
State. As regards the merits the Court would note the following:
in their application to the Council of State, the applicants
indicated the deeds on which they based their claim that they were
owners of the disputed land. The Council of State, although it was
not called upon to determine the issue of the ownership status,
and in any event could not do so, admitted that the applicants,
who "were considered as owners", had locus standi.
35. For the purposes of the proceedings before the Court, the
applicants could therefore be regarded as the owners of the land
in issue or at least that they had an interest that would normally
be protected by Article 1 of Protocol No. 1 to the Convention.
36. The Court takes note of the Government's arguments that the
protection of forests is guaranteed without any time-limit and is
not obstructed by any illegal destruction or deforestation.
Moreover, the declaration of an area as an area to be reafforested
and the prohibition of any use that would obstruct reafforestation
is not left to the discretion of the Administration but is
mandatory and the Council of State has scrupulously enforced these
principles in order to safeguard the forest resources of the
country. The Court also notes that the applicants contest that the
prefect's decision to reafforest in the present case was taken in
the public interest, because the geology of the whole area is not
appropriate for forestation. The Court notes that there exists
plenty of conflicting evidence as to the character of the land in
issue. As both parties point out, judicial and administrative
decisions, experts valuations and various documents could be used
in support of the position of each party. However, it is not for
the Court to take position on such a technical matter.
37. The Court notes that the prefect's decision of 10 October
1994 was based on the decision No. 108424/1934 of the Minister of
Agriculture. In the Court's opinion the authorities would be at
fault for ordering such a serious measure affecting the position
of the applicants and of a certain number of other persons who
claimed property rights on the wider area without a fresh
reassessment of the situation as depicted in decision No.
108424/1934. However, the Council of State rejected the
applicants' application on the sole ground that the prefect's
decision was not an executory act since it simply confirmed the
decision issued by the Minister of Agriculture in 1934. Such a
manner to proceed in such a complex situation in which any
administrative decision may weigh heavily on the properties of a
great number of persons cannot be considered as respectful of the
right enshrined in Article 1 of Protocol No. 1 and does not
provide an adequate protection to those who bona fide possess or
own property, as the applicants, in particular taking into account
that there is no possibility of obtaining compensation under Greek
law.
38. The Court considers that the situation of which the
applicants complain falls under the first sentence of the first
paragraph of Article 1 of Protocol No. 1 and that there was no
reasonable balance struck between the public interest and the
requirements of the protection of the applicants' rights.
39. Accordingly, there has been a violation of Article 1 of
Protocol No. 1.
II. Application of Article 41 of the Convention
40. Article 41 of the Convention provides:
"If the Court finds that there has been a violation of the
Convention or the Protocols thereto, and if the internal law of
the High Contracting Party concerned allows only partial
reparation to be made, the Court shall, if necessary, afford just
satisfaction to the injured party."
41. For pecuniary damage the applicants claimed 504,482,000
drachmas (GRD) or 1,480,505 euros (EUR). This amount is based on
an expert valuation carried out by a civil engineer appointed by
the applicants to assess the value of all the disputed plots. The
expert based the assessment on the market value of the
neighbouring properties and on a judgment of the First instance
Court of Athens which determined the amount per square metre for
the compensation of a property expropriated for the purposes of
the Olympics in 2004.
42. For non-pecuniary damage the applicants declared that a
judgment of the Court holding that there has been a violation of
Article 1 of Protocol No. 1 would constitute sufficient just
satisfaction and they claimed token compensation of one euro. They
affirmed that the interference of the State with their properties
caused them distress and anxiety and that the inconvenience in
which they had found themselves was quite serious if one took into
account the fact that most of them had bought these properties at
a very high cost at the time and with their humble financial
means.
43. As regards costs and expenses for the proceedings before
the Council of State, the applicants claimed GRD 200 000 per
expropriated plot, that is a total of GRD 4,800,000 or EUR 14,087.
For the proceedings before the Court the applicants underlined the
complexity of the case and the need to have recourse to two
lawyers who spent 980 working hours on the file for an hourly rate
of GRD 50,000 (total: GRD 49,000,000 or EUR 143,800). To that sum
should be added an amount of GRD 1,000,000 for various secretarial
expenses and of GRD 1,000,000 for the fees of the civil engineer
who assessed the applicants' properties.
44. The Government submitted that the applicants had no right
to compensation: on the one hand, they had not been recognised as
owners of the disputed plots by the civil courts and, on the other
hand, the decision to reafforest did not prohibit any use of the
land but only the use that would hinder reafforestation and would
be inconsistent with the forest character of these plots. The
Government reiterates that they contest the exact location and
surface of the plots.
45. The Government submitted that the applicants' claims for
cost were exaggerated and arbitrary. In particular, the number of
working hours and the hourly rate indicated by their lawyers were
excessive.
46. In the circumstances of the case, the Court considers that
the question of the application of Article 41 is not ready for
decision and that it must be reserved, having regard to the
possibility of an agreement between the respondent State and the
applicant.
FOR THESE REASONS, THE COURT UNANIMOUSLY
1. Holds that there has been a violation of Article 1 of
Protocol No. 1;
2. Holds that the question of the application of Article 41 is
not ready for decision;
accordingly,
(a) reserves the said question in whole;
(b) invites the Government and the applicant to submit, within
the forthcoming three months, their written observations on the
matter and, in particular, to notify the Court of any agreement
that they may reach;
(c) reserves the further procedure and delegates to the
President of the Chamber the power to fix the same if need be.
